1980s AI Photo is independently operated. For privacy inquiries or requests, contact support@1980saiphoto.com.
1. Scope and who we are
This Privacy Policy explains how 1980s AI Photo ("1980s AI Photo," "we," "us" or "our") collects, uses, discloses and retains personal information when you visit 1980saiphoto.com, create an account, purchase credits or a subscription, use our AI image generation tools, or contact us. The operator of 1980s AI Photo is the controller of the personal information described in this policy. You can contact us at support@1980saiphoto.com.
2. Information we collect
Account and authentication information
When you sign in with Google, we receive information made available for authentication, including your name, email address and profile image. We assign an internal user identifier and maintain your account and credit balance. We also record your most recent login IP address and authentication/session information.
Content and generation information
We process the prompts, uploaded portraits and generation settings you submit. We also maintain generation request identifiers, status, generated image URLs, output and storage metadata, timestamps, credits charged, refund status and failure information. Uploaded images may contain personal information about you or other people.
Payment and subscription information
PayPal processes checkout and payment credentials. We do not receive or store your full card number or PayPal password. We do maintain records needed to provide paid features and administer transactions, including PayPal order, capture, transaction and subscription identifiers; the plan purchased; price and currency; payment and subscription status; billing and entitlement dates; credits granted or reversed; and refund, reversal or dispute information.
Technical, usage and communications information
We may collect IP address, browser or device information, cookie and session identifiers, request and security logs, pages or features used, and diagnostic information. If you contact us, we process your email address, message and any information you choose to provide. Where analytics is enabled, we may receive traffic and interaction measurements.
3. How and why we use information
We use this information to authenticate users; provide and store requested image generations; maintain creation history; calculate, deduct and refund credits; process purchases and subscriptions; provide customer support; secure, troubleshoot and improve the service; prevent fraud, abuse and duplicate requests; enforce our terms; handle payment disputes; and comply with legal, tax, accounting and regulatory obligations.
Where applicable law requires a legal basis, we rely on performance of our contract with you to provide the service and paid features; our legitimate interests in operating, securing and improving the service and preventing abuse; your consent for non-essential cookies or analytics where required; and compliance with legal obligations.
Prompt safety checks and credit-availability rules may automatically accept or reject a generation request. These checks are used to operate and protect the service and are not intended to make decisions that produce legal or similarly significant effects about you.
4. AI inputs, uploads and outputs
To perform a generation, we send your prompt, generation settings and uploaded portraits to fal.ai and the selected AI model infrastructure. fal.ai returns generation status and an output image. The provider returns an output image so it can be displayed and downloaded. Do not submit confidential information or content that you do not have the right or permission to use, including another person's personal information.
Our own use of submitted content is limited to providing, securing, supporting and improving the service as described in this policy. Third-party providers process data under their applicable contracts and privacy terms. Their own retention practices may differ from ours, so you should avoid submitting information that is not necessary for the generation.
5. Cookies and analytics
We use essential cookies and similar technologies to keep you signed in, maintain sessions, secure the service and remember necessary preferences. These technologies are required for requested functionality.
Google Analytics may be enabled on portions of the site to measure visits and interactions. Analytics can involve cookies and information such as device, browser, approximate location derived from IP address, pages viewed and interaction events. Where required, we will rely on consent for non-essential analytics. You can also restrict cookies through your browser; doing so may affect site functionality.
6. How we disclose information
We disclose information only as reasonably necessary for the purposes described above, including to:
- Google for sign-in and account authentication;
- PayPal for checkout, payments, subscriptions, refunds, reversals and disputes;
- fal.ai and its model infrastructure for file upload and AI image generation;
- hosting, database, security, analytics and technical service providers that help operate the service;
- professional advisers, authorities or other parties when reasonably necessary to comply with law, protect rights and safety, investigate abuse or fraud, or establish and defend legal claims; and
- a buyer, successor or adviser in connection with a merger, financing, reorganization or sale of all or part of the service, subject to appropriate safeguards.
We do not sell personal information for money. We do not use personal information for cross-context behavioral advertising.
7. International data transfers
Our users and service providers may be located in different countries. As a result, information may be processed outside your country, including in the United States, where privacy laws may differ. Where required, we use recognized transfer mechanisms or other appropriate safeguards. Contact us if you would like more information about safeguards relevant to your information.
8. Data retention
Uploaded files and generated outputs may be retained by model and infrastructure providers according to their terms. We retain account, credit, payment and security records only as reasonably necessary to operate the service, resolve disputes, prevent abuse and meet legal obligations.
We generally retain account information while your account remains active and thereafter only as reasonably necessary for the purposes described in this policy. Payment, subscription, credit, refund and dispute records may be kept for the period required for accounting, tax, fraud prevention, dispute resolution and legal compliance. Security logs and support communications are retained for a period appropriate to their purpose. When information is no longer needed, we delete or anonymize it, subject to backup cycles and legal obligations.
9. Security
We use reasonable technical and organizational measures designed to protect information, including authenticated access to account history, server-side payment and credit validation, and restricted service credentials. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
10. Your privacy rights and choices
Depending on where you live, you may have the right to request access to, correction of, deletion of, or a portable copy of your personal information; restrict or object to certain processing; withdraw consent where processing is based on consent; and appeal or complain to a privacy regulator. You may sign out and control cookies through your browser or available consent controls.
To make a privacy request, email support@1980saiphoto.com from the address associated with your account and describe your request. We may need to verify your identity. We will respond as required by applicable law. Some information may be retained when necessary to complete a transaction, protect the service, comply with law, or establish or defend legal claims. Authorized agents may submit requests where permitted by law, subject to verification of their authority.
11. Children
The service is not directed to children under 13 or below the minimum age at which they may lawfully use the service in their jurisdiction. We do not knowingly collect personal information from children in violation of applicable law. If you believe a child has provided personal information, contact us so we can investigate and take appropriate action.
12. Changes to this policy
We may update this policy as the service, providers or legal requirements change. We will post the updated policy and revise its effective date. If a change materially affects how we use previously collected information, we will provide additional notice or obtain consent when required.
